These Terms of Use ("Terms") govern your access to and use of the SilenceRemover iOS application ("the App"), operated by Mobixoft LLC ("we", "us", "our"). By installing or using the App you agree to these Terms. If you do not agree, do not use the App.
1. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on iOS devices you own or control, solely for your personal, non-commercial or internal business use, and subject to these Terms and the Apple Media Services Terms and Conditions.
2. Permitted Use
You agree to use the App only with media you own or have the right to edit. You are solely responsible for the content you import and for complying with any third-party licenses (including those of content creators and rights holders).
3. Prohibited Use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from the App, except to the extent permitted by applicable law.
- Use the App to process content for which you do not hold the necessary rights.
- Circumvent, disable, or otherwise interfere with security-related features of the App.
- Use the App in any way that violates applicable law or regulation.
4. Subscriptions & Billing
The App offers optional auto-renewable subscriptions that unlock premium features. Subscriptions are billed through your Apple ID.
- Payment is charged to your Apple ID at confirmation of purchase.
- Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel subscriptions in Settings → [Your Name] → Subscriptions on your device.
- Any unused portion of a free trial, if offered, will be forfeited when a paid subscription is purchased.
Refunds are handled by Apple. Requests should be submitted at reportaproblem.apple.com.
5. Free Trials
A free trial, when available, converts to a paid subscription automatically at the end of the trial period unless cancelled at least 24 hours before the trial ends. Eligibility for free trials is determined by Apple.
6. User Content
All audio and video files you import remain yours. We do not claim ownership of your content and we do not upload it to any server. You are solely responsible for backing up your content before and after using the App.
7. Intellectual Property
The App, its name "SilenceRemover", logo, interface, and all associated design and software are owned by Mobixoft LLC and are protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks or logos.
8. Third-Party Services
The App relies on third-party services, including Apple App Store, Firebase (Authentication and Remote Config), and RevenueCat. Your use of the App is also subject to those providers' terms. We are not responsible for their availability or content.
9. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that detected silences will match your editorial preferences in every case.
10. Limitation of Liability
To the maximum extent permitted by law, Mobixoft LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or media, loss of revenue, or loss of profits, arising from or related to your use of the App. Our total aggregate liability shall not exceed the amount you paid us, if any, for the App in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold Mobixoft LLC harmless from any claims, damages, or expenses arising from (a) your misuse of the App, (b) your violation of these Terms, or (c) your infringement of any third-party right via content you process with the App.
12. Termination
We may suspend or terminate your access to the App at any time if you breach these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination will survive.
13. Changes to the App or Terms
We may modify, suspend, or discontinue the App or any feature at any time. We may update these Terms by posting the revised version here with a new "Last updated" date. Continued use after changes become effective constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to their personal jurisdiction.
15. Apple End-User License Acknowledgement
These Terms are between you and Mobixoft LLC only, not with Apple Inc. Apple is not responsible for the App or its content. To the extent the App complies with the Apple Media Services Terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
